Briefly: The “Puff Puff” industry sued the Attorney General. But the Justice Department is saying, “Pass.”
What: The DOJ plans to request the dismissal of a lawsuit against U.S. Attorney General Merrick Garland by a coalition of cannabis businesses in Massachusetts challenging federal marijuana prohibition in state markets.
Why: The lawsuit seeks to confirm the rights of Massachusetts and other states to regulate cannabis and argues that prohibition in state markets is unconstitutional and creates public safety risks.
So What? This latest development comes as we await the DEA’s decision on the HHS’s recommendation to reschedule cannabis from Schedule I to Schedule III.

ONE FOR THE ROAD
Briefly: The U.S. Supreme Court is currently deciding if it will, well, decide.
So Basically: SCOTUS justices are deliberating whether to hear an appeal of a circuit court ruling that found restricting cannabis users from owning guns violates the Second Amendment.
Back Up: The legal fight revolves around Section 922, which prohibits “unlawful users” of controlled substances from possessing firearms. But, in a landmark decision last summer, a federal appeals court struck down the ban.
Fast Forward: The Fifth Circuit decision has its fair share of supporters — even surprising ones. Florida Governor Ron DeSantis, who has taken a stance against federal legalization, called the ban “unconstitutional.”
So What? As lawmakers work to extend basic rights to cannabis companies and users alike through bills like the SAFE Banking Act, the firearms issue opens a unique debate, with supporters and critics on both sides of the aisle.
